The terms of this agreement ("Terms of Use") govern the relationship between you and UPDEVTEAM LTD (IAKOVLEV Sole Proprietorship) regarding your use of games, mobile apps, chat rooms, and any other services ("Service") provided by UPDEVTEAM LTD. Use of the Service is also subject to UPDEVTEAM LTD's Privacy Policy, which is an integral part of these Terms of Use.
BY DOWNLOADING, INSTALLING, USING, OR OTHERWISE ACCESSING THE SERVICES PROVIDED BY UPDEVTEAM LTD, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO THESE TERMS OF USE AND PRIVACY POLICY; AND YOU CONFIRM THAT YOU ARE OF LEGAL AGE IN YOUR COUNTRY OF RESIDENCE AND HAVE THE LEGAL RIGHT TO USE THE SERVICES. IF YOU ARE UNDER THE AGE OF LEGAL CAPACITY, YOU CERTIFY THAT YOUR LEGAL REPRESENTATIVE HAS READ AND AGREED TO THESE TERMS OF USE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT DOWNLOAD OR OTHERWISE ACCESS THE UPDEVTEAM LTD SERVICES. USING THE SERVICES WITHOUT AGREEING TO THESE TERMS OF USE IS STRICTLY PROHIBITED.
You may use your account solely for your personal, non-commercial use. You agree that you will not share any of your Account information that is needed to access your account (such as your Google Play or Apple ID account username and password), nor will you provide access to your Account to third parties or take any action that may compromise the security of your Account and the information required to log into your Account, and you will be solely responsible for any use of your authorization data, including any purchase or modification made to your Account, whether they are authorized by you personally or not. Furthermore, you acknowledge that you are responsible for any activity that occurs through your Account and/or with your Account as a result of your providing your login details to third parties. In the event that you witness or reasonably suspect a breach of security, including, without limitation, any loss, theft or unauthorized disclosure of information required to log into your Account, you agree to immediately notify UPDEVTEAM LTD and change the authorization data. Without a timely notice, we cannot guarantee the security of your progress in our Services.
All rights to the Services, including all apps, computer codes, objects, characters, dialogues, concepts, catchphrases, artwork, animation, sounds and audio effects, musical compositions, audiovisual effects, operating methods, documentation, in-game chat transcripts, information about characters, game recordings using game clients and server equipment are the property of UPDEVTEAM LTD.
UPDEVTEAM LTD owns all data that is part of the Services. You acknowledge and confirm that any in-game content provided as part of the Services, including without limitation (a) “Virtual Property”, (b) “Virtual Currency” or (c) “Merchandise” present in the Services provided by UPDEVTEAM LTD, does not belong to you, and you do not have any rights to them, regardless of whether you purchased a license for them from UPDEVTEAM LTD or received it for free within the Services. You acknowledge and agree that you do not own your Account and have no rights to it, and that all rights to your Account are and will always be the property of UPDEVTEAM LTD.
UPDEVTEAM LTD hereby grants you a non-exclusive, revocable, non-transferable license to access UPDEVTEAM LTD’s Services for your non-commercial, purely entertaining purposes, subject to your agreement to these Terms of Use.
Except as expressly authorized in writing by UPDEVTEAM LTD, you may not reproduce, distribute, copy, modify, publish, create derivative works of the Services, or any intellectual property owned by UPDEVTEAM LTD.
Any infringement or use in violation of these Terms of Use is strictly prohibited and may result in civil or criminal penalties.
You acknowledge that while using the UPDEVTEAM LTD Services, you will not, under any circumstances:
Initiate, take part (directly or indirectly) in any type of attack, including hacking, distribution and/or use of any viruses, computer worms, malware or codes designed to interfere with the Services and any of their internal features or any attempt to disrupt the functioning of the Services and interfere with the use of Services by other users.
Harass, insult, threaten, intimidate other users, or post any obscene, offensive, pornographic or illegal content that would violate the rights of other users.
Use the system errors of the Services provided and/or distribute them, as well as agitate in any way the use of these errors by other users.
Attempt to gain access to the Account of another user, collect and store personal data of other users, and also attempt to obtain authorization data of other users.
Attempt to gain unauthorized access to the Services, in particular to Accounts registered to other users, to servers or networks connected to the Services not through the user interface provided by UPDEVTEAM LTD, including bypassing or modifying any means of protecting the Services, attempting and/or inciting or facilitating circumvention or modification.
Use any software, technology or code in the Services to collect content, other users' personal data, or any other information stored in the Services, including any user information.
Advocate, encourage, support or in any other way facilitate any illegal behavior (including distribution of drugs, illegal gambling, theft, harm to human life and health), or contribute to the disregard and/or violation of these Terms of Use.
As part of the Services, you have the option to use “real” money to purchase a non-exclusive, non-transferable, privately sublicensable, revocable license to use “Virtual Property” such as: (a) “Virtual Currency”, (b) “Virtual In-Game Items”, (c) other goods or services.
You have the right to purchase Virtual Property exclusively from UPDEVTEAM LTD or from partners authorized by us, any other methods of acquisition are prohibited.
You acknowledge that any Virtual Property for which you have purchased a license is not your property and does not belong to you. Virtual Property has no monetary value and cannot be purchased for cash. You agree that all acquisitions of licenses to use Virtual Property are final and non-exchangeable and non-refundable unless authorized by UPDEVTEAM LTD in writing.
UPDEVTEAM LTD reserves the right to change and/or reduce the license price for Virtual Property, reduce the number of available licenses or make them unavailable for purchase, and may at any time adjust, modify, change or delete Virtual Property with or without notice. UPDEVTEAM LTD shall not be liable to you or any third parties in the event that UPDEVTEAM LTD exercises any of the above rights.
UPDEVTEAM LTD’s Services may include the ability to participate in group conversations, surveys (both public and private), or in any other way create, send and publish texts, graphics and other materials ("User Content"). You agree, warrant and undertake that any materials created, submitted and/or published by you are (a) non-confidential, (b) not misleading or false, (c) not contrary to any laws, contractual obligations, and do not violate rights of third parties, (c) these materials do not contain personal data or intellectual property that you do not have permission to use, or any viruses, malware, computer worms or any other malicious code, (d) you acknowledge and agree that any personal data provided by you within the User Content may be processed and used by UPDEVTEAM LTD in accordance with these Terms of Use.
You acknowledge and agree that while using UPDEVTEAM LTD’s Services, you may be exposed to User Content and actions of other users that are offensive, obscene or do not meet your expectations. UPDEVTEAM LTD reserves the right, at its sole discretion, to review, edit, refuse to publish or remove any User Content. You acknowledge and agree that UPDEVTEAM LTD, however, has no obligation to moderate or remove inappropriate User Content and that UPDEVTEAM LTD shall not be liable to you or third parties in any way for User Content, as well as for any losses incurred, associated with it.
UPDEVTEAM LTD reserves the right to modify and update any components of the Services, including Virtual Property, Virtual In-Game Items, as well as any other in-game mechanics, functions and specifications of the Services with or without prior notice. UPDEVTEAM LTD is not responsible to you for any updates and modifications to the product and any of its components.
You acknowledge and agree that UPDEVTEAM LTD may require you to download and install updates to the Services in order to continue accessing and using them. You also acknowledge and agree that with or without prior notice, UPDEVTEAM LTD may post automatic updates and/or modifications of the Services that do not require you to manually install them.
You acknowledge and acknowledge that if, under any circumstances, you violate any of these Terms of Use, whether the violation was intentional or accidental, these Terms of Use will automatically terminate. Upon termination, you must immediately suspend any use of the UPDEVTEAM LTD Services. You acknowledge and agree that UPDEVTEAM LTD has the right to deactivate and/or delete your account at any time for any reason or without one, with or without prior notice. You agree that your obligations specified in the following paragraphs: 2. Rights and License Restrictions, 3. License Limitation, 5. User Content will remain in force after the termination of these Terms of Use.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPDEVTEAM LTD MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, AND EXPRESSLY DISCLAIMS ANY WARRANTIES, EXPRESSED OR IMPLIED BY LAW, REGARDING THE SERVICES PROVIDED. ALL UPDEVTEAM LTD’s SERVICES ARE PROVIDED "AS IS", AND UPDEVTEAM LTD DOES NOT WARRANT THAT THEY WILL MEET YOUR NEEDS AND/OR EXPECTATIONS, WILL BE SECURE, OPERATE STABLY, OR THAT THEY WILL BE FREE OF ANY VIRUSES OR OTHER HARMFUL COMPONENTS.
UPDEVTEAM LTD AND ITS EMPLOYEES SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, SPECIAL DAMAGES, PUNITIVE DAMAGES, LOST PROFITS OR LOST DATA, REGARDLESS OF WHETHER THOSE DAMAGES WERE ANTICIPATED.
You acknowledge and agree that UPDEVTEAM LTD reserves the right to update, amend or modify these Terms of Use and/or Privacy Policy at any time by posting an updated version on the website: https://humdes.app website. The updated Terms of Use and/or Privacy Policy are effective immediately upon posting at https://humdes.app. You are advised to check the website for such updates from time to time.
Only the English version of this document is legally binding. All translations of this document are provided solely for your convenience.
